In order to conduct a business of concluding contracts which enable processing of credit card numbers, etc. The Applicant is: (10) A corporation that has not established a system necessary for performing a Money Lending Business appropriately; or (11) A corporation whose other business is contrary to the public interest with merchants on a regular basis, the business operator must, pursuant to the Installment Sales Act, establish a place of business in Japan, make an application for registration with the relevant Bureau of Economy, Trade and Industry, and be registered by the Minister of Economy, Trade and Industry (Article 35-17-2 and 35-17-3 of the Installment Sales Act). The registered entity must be a corporation. Outline of registration procedures The applicant must submit the statutorily required application form, with the necessary documents attached. The application will be reviewed, and registration as a Business Operator which Concludes Contracts to Process Credit Card Numbers, etc. will be granted unless there are grounds to refuse registration, or there is a material false statement or material omission in the application form or the attached documents. Grounds for refusal of registration (Article 35-17-5 of the Installment Sales Act) (1) A person who is not a corporation; (2) A foreign corporation that does not have a place of business in Japan; (3) A corporation whose registration has been revoked pursuant to the provisions of Article 35-17-11(1) or (2), and less than five years have passed from the date of such revocation; (4) A corporation that has been sentenced to a fine pursuant to the provisions of this Act, unless five years have passed since the day on which it finished serving the sentence or ceased to be subject to the sentence; (5) A corporation with an officer that falls under any of the following: (a) a bankrupt person who has not been released from bankruptcy restrictions; (b) a person who has been sentenced to imprisonment without work or a heavier punishment, unless five years have passed since the day on which the person finished serving the sentence or ceased to be subject to the sentence; (c) a person who has violated the provisions of this Act or the Act on Prevention of Unjust Acts by Organized Crime Group Members (excluding the provisions of Article 32-3(7) and 32-11(1) of the said Act), or committed a crime under the Penal Code or Act on Punishment of Violence and Other Acts and been sentenced to a fine, unless five years have passed since the day on which the person finished serving the sentence or ceased to be subject to the sentence; or (d) a person who was previously an officer of a Business Operator which Concludes Contracts to Process Credit Card Numbers, etc. (a person registered pursuant to Article 35-17-2; hereinafter the same) that had its registration revoked pursuant to Article 35-17-11(1) or (2) in the 30 days prior to that revocation, unless five years have passed since the date of that revocation; or (e) an Organized Crime Group Member, etc. (6) A corporation whose business activities are controlled by an Organized Crime Group Member, etc.; (7) A corporation which is likely to engage an Organized Crime Group Member, etc. in its business operations or to use an Organized Crime Group Member, etc. as an assistant in those operations; (8) A corporation that is found not to have established the systems set forth in the ministerial order g.
